You may not share your account credentials with any third party. We reserve the right to suspend or terminate any account that we reasonably believe has been compromised or is being used in violation of these Terms.
Truthe is a technology platform. We provide an online platform that connects patients with independent, licensed healthcare providers ("Providers") who deliver telehealth consultations, evaluate patient eligibility for treatment, and issue prescriptions when clinically appropriate.
Truthe is not a healthcare provider. We do not practice medicine, provide medical diagnoses, or prescribe medications. The provider-patient relationship is established directly between you and the licensed Provider who evaluates and treats you through our platform. All clinical decisions — including whether to prescribe a medication, which medication to prescribe, and at what dosage — are made solely by the treating Provider in their independent medical judgment.
Truthe does not guarantee treatment. Submitting an intake form or completing a purchase does not guarantee that a Provider will prescribe any particular treatment. If a Provider determines that a treatment is not appropriate for you, we will issue a full refund for the prescription portion of your order.
The content on our Site and within our Services — including blog articles, product descriptions, wellness quizzes, and educational materials — is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment. This content should not be used as a substitute for professional medical advice from a qualified healthcare provider.

Certain Services are offered on a recurring subscription basis. When you subscribe, you authorize us to charge your selected payment method on a recurring basis (monthly or as otherwise specified) until you cancel.
All subscriptions auto-renew at the end of each billing cycle at the then-current price unless you cancel before the renewal date. We will notify you of any price changes at least thirty (30) days before they take effect.
You may cancel your subscription at any time through your patient portal or by contacting us at support@truthehealth.com. Cancellation takes effect at the end of the current billing period. You will continue to have access to your subscription benefits until the end of the period for which you have paid. No refund will be issued for the current billing period.
Refunds are subject to our Refund Policy, which is incorporated into these Terms by reference.
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, trademarks, images, software, and design elements — are the exclusive property of Truthe Health, LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our Services without our prior written consent, except as permitted by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUTHE HEALTH, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
TRUTHE IS NOT LIABLE FOR ANY CLINICAL DECISIONS MADE BY INDEPENDENT HEALTHCARE PROVIDERS, ADVERSE REACTIONS TO PRESCRIBED MEDICATIONS, OR THE QUALITY OF PRODUCTS DISPENSED BY THIRD-PARTY PHARMACIES.
You agree to indemnify, defend, and hold harmless Truthe Health, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Before initiating any formal dispute resolution proceeding, you agree to contact us at legal@truthehealth.com and attempt to resolve the dispute informally for at least thirty (30) days.
If we are unable to resolve the dispute informally, any controversy or claim arising out of or relating to these Terms or the Services shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
YOU AND TRUTHE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the State of Delaware.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with the Privacy Policy, Refund Policy, Telehealth Informed Consent, and any other legal notices or agreements published on the Site, constitute the entire agreement between you and Truthe with respect to the Services.
