This Privacy Policy describes how Truthe Health Inc., a Wyoming corporation, together with its subsidiaries and affiliated entities, including Truthe Supplements LLC and Truthe Medical LLC (collectively, "Truthe," "we," "us," or "our"), collects, uses, discloses, and protects information about you when you visit or use the website located at truthehealth.com, together with all related subdomains, patient and partner portals, and any other websites, applications, or online services operated by Truthe that link to this Privacy Policy (collectively, the "Truthe Sites"), when you purchase products or enroll in programs, and when you otherwise interact with us. Capitalized terms not defined here have the meanings given in our Terms of Use and Terms of Sale.
By using the Truthe Sites, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, do not use the Truthe Sites. Section 6 (Consumer Health Data) contains additional disclosures and consent terms that apply to consumer health data, and is also published as a standalone Consumer Health Data Privacy Policy where required by applicable law.
This Privacy Policy applies to information we collect through the Truthe Sites and in connection with our own products, programs, and communications. It does not apply to:
Where Truthe receives protected health information as a business associate of a covered entity under the Health Insurance Portability and Accountability Act ("HIPAA"), that information is governed by HIPAA, the applicable business associate agreement, and the covered entity's notice of privacy practices, and is used and disclosed only as permitted by those authorities. This Privacy Policy applies to that information only to the extent consistent with HIPAA and those agreements.
We collect the following categories of information:
You are not required to provide information to browse the public areas of the Truthe Sites, but certain information is required to create an account, place an order, or use specific features. Do not submit sensitive health information through general contact forms, public reviews, or chat tools that are not identified as secure.
We collect information: (a) directly from you, when you create an account, place an order, complete a form, enroll in a program, communicate with us, or otherwise provide it; (b) automatically, through cookies and similar technologies when you use the Truthe Sites; (c) from service providers acting on our behalf, such as payment processors (limited transaction details), shipping carriers (delivery status), and analytics providers; and (d) from the Telehealth Vendor, limited to what is necessary to operate your Truthe account and display your program information to you, under the agreements described in Section 1.
We do not accept patient lists or patient rosters from healthcare practices for marketing purposes. You become a Truthe contact only through your own action, such as creating an account, placing an order, scanning an enrollment code, or opting in to communications.
We use the information we collect to:

This Section 6 serves as our Consumer Health Data Privacy Policy and applies to "consumer health data" as defined by applicable state law, including the Washington My Health My Data Act and Nevada Senate Bill 370: personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. To the extent this Section conflicts with any other part of this Privacy Policy with respect to consumer health data, this Section controls. This Section does not apply to information governed by HIPAA as described in Section 1.
6.1 Categories of Consumer Health Data We Collect
Depending on how you interact with us, we may collect: information about surgical procedures, recovery status, health conditions, or symptoms that you choose to share with us; information about your purchase and use of health-related products, including supplements and wellness programs; health-related preferences and goals you provide in questionnaires or surveys; messages you send us that contain health information; and inferences we draw from the foregoing to provide the services you request, such as which program applies to your account.
6.2 Purposes and Consent
We collect and use consumer health data only: (a) as necessary to provide a product or service you have requested, such as processing your order, servicing your account, and displaying your program information to you; or (b) with your consent for any other purpose, obtained before collection or use for that purpose. We share consumer health data only as necessary to provide products or services you have requested (including with the service providers described in Section 5, under binding contracts) or with your separate consent. We do not sell consumer health data, and we will not sell consumer health data without first obtaining a valid written authorization from you that complies with applicable law. We do not use geofencing around any facility that provides in-person health care services to identify, track, or collect data from, or send notifications to, consumers. Where consent is required for the collection or sharing of consumer health data, we obtain it through a separate, affirmative consent mechanism presented to you at the point of collection; your acceptance of this Privacy Policy is not, by itself, consent to the collection or sharing of consumer health data.
6.3 Categories of Recipients
Consumer health data may be shared with: our processors and service providers (cloud hosting and storage, order fulfillment and shipping, email and text delivery, customer support, and security providers), acting under contracts that bind them to this Section; the Telehealth Vendor and its network, at your direction, when you request prescription services; your healthcare practice, only with your separate consent; our corporate affiliates identified in this Privacy Policy; and government authorities where required by law. A list of the third parties and affiliates with whom we have shared or to whom we have sold consumer health data, and contact information for those parties, is available upon request as described in Section 6.4.
6.4 Your Consumer Health Data Rights
If you are a resident of Washington, Nevada, or another state providing similar rights, or your consumer health data was collected there, you have the right to: (a) confirm whether we are collecting, sharing, or selling your consumer health data and access that data, including a list of the third parties and affiliates, if any, with whom we have shared or to whom we have sold it and an email address or other online mechanism to contact them; (b) withdraw your consent to our collection or sharing of your consumer health data; and (c) request that we delete your consumer health data. To exercise these rights, contact us at support@truthehealth.com with the subject line "Consumer Health Data Request." We will verify your request using information associated with your account and respond within the time required by applicable law. If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal"; we will respond to your appeal within the time required by law, and if your appeal is denied, you may contact the Attorney General of your state.
We use analytics services to understand how the Truthe Sites are used, and we may use advertising services to reach people who may be interested in our products. These services may use cookies, pixels, and similar technologies to collect device and usage information as described in Section 8. Where the disclosure of information to advertising partners would constitute "sharing" for cross-context behavioral advertising or "targeted advertising" under applicable state privacy laws, you may opt out as described in Sections 8 and 10. We configure our advertising technologies to operate without health-status information, we do not permit third-party advertising cookies or pixels to operate on authenticated portal pages that display health-related information, and to the extent any advertising or analytics technology would collect consumer health data, we do not deploy it without first obtaining any consent required by applicable law.
The Truthe Sites use: (a) strictly necessary cookies, required for the Truthe Sites to function (authentication, security, shopping cart); (b) analytics cookies, which help us understand site usage; and (c) advertising cookies, which support our marketing. You can control cookies through our cookie preference tools where offered, through your browser settings (which typically allow you to refuse or delete cookies), and through the opt-out mechanisms described in Section 10. Blocking some cookies may impair site functionality. If you use chat or messaging features on the Truthe Sites, your communications and related metadata may be processed and stored by us and by service providers that operate those features on our behalf, and by using those features you consent to that processing. We honor opt-out preference signals recognized under applicable law, such as the Global Privacy Control, as an opt-out of sharing and targeted advertising for the browser or device sending the signal.
Creating an account or making a purchase requires you to accept the Terms of Sale and this Privacy Policy so we can service you, but marketing consent is separate: we ask for your marketing opt-in through a distinct, unchecked consent at signup or enrollment, and declining it does not affect your ability to purchase or use the Services.
You may opt out of marketing emails at any time by using the unsubscribe link in any marketing email, and you may opt out of marketing text messages by replying STOP to any message. Opt-outs are processed within the time required by applicable law. Even after you opt out of marketing, we will continue to send transactional and account communications, such as order confirmations, shipping notices, safety notices, and responses to your inquiries.
From time to time we may offer discounts, promotional items, or other incentives in connection with signing up for communications or programs. The material terms of any incentive are disclosed at the time of the offer, participation is voluntary and requires your opt-in, you may withdraw at any time by opting out as described above, and any incentive is reasonably related to the value of the information involved, as required by applicable law.
Depending on your state of residence, you may have some or all of the following rights with respect to your personal information: to know or access the personal information we have collected about you, including in a portable format; to correct inaccurate personal information; to delete personal information; to opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, targeted advertising, and certain profiling; and to limit the use of sensitive personal information where applicable. We do not sell personal information. Consumer health data rights are described in Section 6.4.
To exercise your rights, contact us at support@truthehealth.com with the subject line "Privacy Request," or use any request mechanism provided on the Truthe Sites. We will verify your identity using information associated with your account, such as your email address and recent order activity, and we may request additional information where necessary to verify your request. You may use an authorized agent to submit a request on your behalf if you provide the agent with signed permission and we can verify your identity. We will respond within the time required by applicable law and will not discriminate against you for exercising your rights. If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Appeal," and we will respond within the time required by law; if your appeal is denied, you may contact your state Attorney General.
This Section supplements this Privacy Policy for California residents under the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA"). In the preceding twelve (12) months, we have collected the categories of personal information described in Section 2, which correspond to the following CCPA categories: identifiers; customer records; commercial information; internet or other electronic network activity information; approximate geolocation derived from IP address; professional information; sensitive personal information limited to account credentials and health-related information you choose to provide; and inferences drawn from the foregoing. We collect these categories from the sources described in Section 3, use them for the purposes described in Sections 4 and 6, and disclose them for business purposes to the categories of recipients described in Section 5.
We do not sell personal information, and we have not sold personal information in the preceding twelve (12) months. If our use of advertising cookies constitutes "sharing" for cross-context behavioral advertising, you may opt out through the cookie controls and opt-out preference signals described in Section 8. We use sensitive personal information only for the purposes permitted by the CCPA without a right to limit, such as providing the services you request, security, and quality assurance; if that changes, we will provide a "Limit the Use of My Sensitive Personal Information" mechanism. California residents may exercise the rights described in Section 10, including through an authorized agent, and will not be discriminated against for doing so. We retain each category of personal information for the periods described in Section 12. California's "Shine the Light" law permits California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes; we do not disclose personal information to third parties for their own direct marketing purposes.
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, and as required by law. In deciding how long to retain information, we consider: the nature of our relationship with you and the products you have purchased; legal, tax, accounting, and regulatory retention requirements, including product safety, adverse event, and healthcare recordkeeping obligations that may require multi-year retention of order and program records; the need to establish, exercise, or defend legal claims; and our legitimate operational needs, such as security and fraud prevention. When retention is no longer necessary, we delete, de-identify, or securely archive the information. Consumer health data is deleted upon a verified deletion request as described in Section 6.4, subject to exceptions permitted by applicable law.
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit and at rest for sensitive systems, access controls and authentication, network monitoring and logging, segregation of health-related data in restricted systems, and vendor contracts imposing security obligations. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials. If a breach of security affecting your personal information occurs, we will notify you and regulators as required by applicable law.
The Truthe Sites are intended for adults. We do not knowingly collect personal information from anyone under eighteen (18) years of age, and no one under eighteen (18) may create an account or make a purchase. If you believe a person under eighteen (18) has provided personal information to us, contact support@truthehealth.com and we will delete it as required by law.
Some browsers transmit "Do Not Track" signals. Because there is no industry standard for responding to Do Not Track signals, we do not respond to them at this time. We do, however, honor recognized opt-out preference signals such as the Global Privacy Control as described in Section 8.
The Truthe Sites are operated from the United States and are intended for users located in the United States. Information we collect is stored and processed in the United States. If you access the Truthe Sites from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those of your jurisdiction.
We may update this Privacy Policy from time to time. When we make material changes, we will post the revised policy with an updated "Last Updated" date and, where required by applicable law, provide additional notice or obtain your consent, including any new consent required before materially different collection, use, or sharing of consumer health data. Your continued use of the Truthe Sites after changes take effect constitutes your acknowledgment of the revised Privacy Policy.
