These Terms of Use (these "Terms") are a binding agreement between you ("you" or "user") and Truthe Health Inc., a Wyoming corporation, together with its subsidiaries and affiliated entities, including Truthe Supplements LLC and Truthe Medical LLC (collectively, "Truthe," "we," "us," or "our"). These Terms govern your access to and use of the website located at truthehealth.com, together with all related subdomains, pages, patient and partner portals, mobile experiences, and any other websites, applications, or online services operated by Truthe that link to these Terms (collectively, the "Truthe Sites"), and all content, features, tools, programs, and services made available through them (collectively, with the Truthe Sites, the "Services").
By accessing or using the Truthe Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. Where you are presented with these Terms and asked to affirmatively accept them, such as at account creation, enrollment, or checkout, your click, checkbox, or other affirmative act constitutes your electronic signature and unambiguous agreement to these Terms, including Section 25. Certain products, programs, and features are governed by additional terms, including our Terms of Sale, subscription terms presented at enrollment, affiliate or ambassador program terms, promotion rules, and telehealth consents (collectively, "Additional Terms"). Additional Terms are incorporated into these Terms by reference when they apply to you. If Additional Terms conflict with these Terms, the Additional Terms control for the specific product, program, or feature to which they relate. All purchases made through the Truthe Sites are governed by the Terms of Sale.
We may revise these Terms at any time. When we make material changes, we will post the revised Terms with an updated "Last Updated" date and, where required by applicable law, provide additional notice or obtain renewed consent. Changes take effect as of the Last Updated date. Your continued use of the Truthe Sites after changes take effect constitutes your acceptance of the revised Terms. Changes do not apply retroactively to a dispute of which we had written notice before the change took effect.
The Truthe Sites are intended for use by individuals who are at least eighteen (18) years of age and located in the United States. By using the Truthe Sites, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into a binding contract. The Truthe Sites are not directed to children, and we do not knowingly collect information from anyone under the age of eighteen (18).

THE TRUTHE SITES AND ALL CONTENT ON THEM, INCLUDING ARTICLES, PROTOCOL DESCRIPTIONS, INGREDIENT AND COMPOUND INFORMATION, DOSING FRAMEWORKS, VIDEOS, TOOLS, CALCULATORS, CHAT FEATURES, AND EDUCATIONAL MATERIALS (COLLECTIVELY, "CONTENT"), ARE PROVIDED FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. CONTENT IS NOT MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT, AND IS NOT A SUBSTITUTE FOR THE PROFESSIONAL JUDGMENT OF A QUALIFIED HEALTHCARE PROVIDER. TRUTHE IS NOT A HEALTHCARE PROVIDER, IS NOT A PHARMACY, AND DOES NOT PRACTICE MEDICINE, NURSING, OR PHARMACY. YOUR USE OF THE TRUTHE SITES, AND ANY COMMUNICATION FROM TRUTHE IN CONNECTION WITH YOUR USE OF THE TRUTHE SITES, DOES NOT CREATE A PHYSICIAN-PATIENT, PROVIDER-PATIENT, PHARMACIST-PATIENT, OR ANY OTHER CLINICAL OR PROFESSIONAL RELATIONSHIP BETWEEN YOU AND TRUTHE. ANY INFORMATION PROVIDED THROUGH AUTOMATED CHAT OR OTHER AUTOMATED TOOLS ON THE TRUTHE SITES IS INCLUDED WITHIN THESE DISCLAIMERS AND DOES NOT CONSTITUTE MEDICAL ADVICE.
Always seek the advice of your physician or another qualified healthcare provider with any questions you may have regarding a medical condition, medication, supplement, therapy, or device, and never disregard or delay seeking professional medical advice because of Content you have read or received on the Truthe Sites. Reliance on any Content is solely at your own risk. Statements on the Truthe Sites regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration ("FDA"), and such products are not intended to diagnose, treat, cure, or prevent any disease.
The Truthe Sites provide access to, and information about, a range of health and wellness products and services, which may include: (a) dietary supplements, vitamins, nutraceuticals, protein and nutrition blends, nutrition programs, and recovery kits; (b) general wellness devices and accessories; (c) educational content and digital tools; (d) patient and partner portals; and (e) access to prescription therapies, including compounded peptide therapies, made available through independent third parties as described in Section 6. The availability of specific products and services varies by state and may change at any time. All purchases are governed by the Terms of Sale, which identify the seller and merchant of record for each product category.
Truthe does not sell, dispense, prescribe, or bill for prescription products, and no prescription product is available from Truthe. Prescription therapies referenced on the Truthe Sites, including compounded peptide therapies, are made available exclusively through an independent third-party telehealth and fulfillment platform (the "Telehealth Vendor") and its nationwide network of independently licensed healthcare providers and state-licensed pharmacies. With respect to prescription products and related clinical services, Truthe acts solely as an intermediary and as a marketing, technology, and administrative services provider. Whether any prescription therapy is appropriate for you is determined exclusively by an independent licensed provider in their sole professional judgment; no outcome, prescription, or therapy is guaranteed; and all clinical services, prescribing decisions, pharmacy services, and payments for prescription products are provided, made, and processed by independent third parties under their own terms and consents, which will be presented to you before you receive those services. Truthe does not endorse or recommend any particular medication, therapy, provider, or pharmacy for any individual. Section 4 of the Terms of Sale contains additional disclosures regarding prescription products, and those disclosures are incorporated into these Terms by reference.
Truthe may offer devices and accessories intended to promote or support a general state of health, wellness, or recovery ("Wellness Devices"). Unless a device's labeling expressly states otherwise, Wellness Devices are intended for general wellness use only, are not medical devices, and are not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease. You must read and follow all instructions, warnings, and labeling provided with any device before use, and rely on the device's physical labeling over Site Content in the event of any conflict. Discontinue use of any device and consult a qualified healthcare provider if you experience discomfort, adverse effects, or symptoms of any kind. Devices are not a substitute for professional medical care, monitoring, or judgment.
Certain features of the Truthe Sites, including patient and partner portals, require you to create an account. You agree to provide truthful, accurate, current, and complete registration information and to keep it updated. You are solely responsible for maintaining the confidentiality of your credentials, for restricting access to your account, and for all activity that occurs under your account. Notify us immediately at support@truthehealth.com of any unauthorized use of your account or other breach of security. We may refuse, suspend, or terminate any account, username, or credential in our reasonable discretion, including for violation of these Terms. You may not sell, transfer, or assign your account.
Our collection, use, and disclosure of information about you is described in our Privacy Policy. Where Truthe receives protected health information in connection with services subject to the Health Insurance Portability and Accountability Act ("HIPAA"), that information is handled in accordance with applicable law and any applicable notice of privacy practices. Health information you provide as part of a clinical intake for prescription services is collected and used by the Telehealth Vendor and its network providers under their own privacy practices and consents. Do not submit sensitive health information through general contact forms, chat tools, reviews, or other public or unsecured features of the Truthe Sites.
By providing your contact information, you agree that we may communicate with you electronically, including by email, regarding your account, transactions, and the Services. You may opt out of marketing emails by following the unsubscribe instructions in any marketing message; we may continue to send you transactional and account-related messages.
If you enroll in a Truthe text message program, you consent to receive recurring automated marketing and informational text messages at the mobile number you provide, which may be sent using an automatic telephone dialing system. Consent to receive marketing text messages is not a condition of any purchase. Message frequency varies, and message and data rates may apply. You may opt out at any time by replying STOP to any message, after which you will receive a single message confirming your opt-out and marketing texts under that program will cease within ten (10) business days; you may obtain help by replying HELP or contacting support@truthehealth.com. Carriers are not liable for delayed or undelivered messages. Your enrollment is subject to any program-specific Additional Terms presented at opt-in.
The Truthe Sites and all Content, including the TRUTHE name and marks, logos, protocol names, text, graphics, photographs, videos, page layouts, designs, data, software, and the selection and arrangement of the foregoing (collectively, the "Materials"), are owned by Truthe or its licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws. Subject to your compliance with these Terms, Truthe grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Truthe Sites and to view and retain a copy of the Materials solely for your personal, non-commercial use. All rights not expressly granted are reserved. No right or license may be implied by estoppel, custom, or otherwise. Any unauthorized use automatically terminates this license.
You agree that you will not, and will not assist or permit any third party to:
We reserve the right to investigate suspected violations of this section, to suspend or terminate access without notice, and to cooperate with law enforcement and disclose information as required by law or legal process.
The Truthe Sites may allow you to submit, post, or transmit reviews, comments, questions, testimonials, photographs, suggestions, ideas, or other content or communications, including through surveys, forms, chat features, email, or text ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Truthe a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully sublicensable, and transferable license to use, reproduce, modify, adapt, translate, publish, publicly display, distribute, and create derivative works from your User Content, and to use the name, likeness, and other identifying information you submit with it, in any media now known or later developed, for the operation, marketing, and promotion of the Services, without compensation or further consent, except as prohibited by applicable law. To the extent permitted by law, you waive any moral rights in your User Content.
You represent and warrant that you own or have all necessary rights to your User Content, that it is truthful and accurate where it states facts (including any review or testimonial), and that it does not violate any law or the rights of any third party. We have no obligation to pre-screen, monitor, publish, or retain User Content, and we may remove, edit, or refuse any User Content in our sole discretion. We are not responsible for User Content, and User Content does not represent our views. Any ideas, suggestions, or feedback you submit regarding the Services ("Feedback") may be used by us for any purpose without obligation to you.
If you submit a review or testimonial, it must reflect your honest opinions and actual experience. You must disclose any material connection you have to Truthe, including receipt of free product, discounts, compensation, or participation in any Truthe affiliate or ambassador program described in Section 15, in accordance with the Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising. Testimonials reflect individual experiences and are not a promise, guarantee, or prediction of any outcome for any other person. Individual results vary.
Truthe may offer marketing affiliate, ambassador, creator, or referral programs (each, an "Affiliate Program"). Participation in any Affiliate Program is subject to separate written program terms, including eligibility criteria, compensation terms, and termination rights, which constitute Additional Terms and which you must accept before participating. Nothing on the Truthe Sites is an offer of Affiliate Program participation, and we may accept or reject any application, and may modify, suspend, or terminate any Affiliate Program, in our sole discretion.

The Truthe Sites may include automated chat, virtual assistant, or other interactive tools that use artificial intelligence or similar technologies ("Automated Tools"). Automated Tools may generate responses automatically, may be powered by third-party providers, and may produce information that is incomplete, inaccurate, or outdated. Automated Tools do not provide medical advice, diagnosis, or treatment, and their output is Content subject to the Medical Disclaimers in Section 4. Do not submit sensitive health information through Automated Tools unless the tool is expressly identified as a secure clinical intake. You are responsible for verifying any information generated by Automated Tools before relying on it.
The Truthe Sites may contain links to, or integrations with, third-party websites, platforms, applications, and services, including the Telehealth Vendor's intake and checkout experiences, payment processors, shipping carriers, and social media platforms. Third-party sites and services are governed by their own terms and privacy policies, which we encourage you to review. We do not control and are not responsible for third-party sites or services, their content, or their practices, and a link or integration does not constitute an endorsement. Your interactions with independent healthcare providers and pharmacies are governed by your agreements and relationships with those parties.
We respect the intellectual property rights of others and expect users to do the same. If you believe that material on the Truthe Sites infringes your copyright, send a written notice to our designated agent that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and information reasonably sufficient to locate it; (c) your name, address, telephone number, and email address; (d) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature. Notices should be sent to: Copyright Agent, Truthe Health Inc., c/o Registered Agents Inc., 30 N Gould St, Ste R, Sheridan, WY 82801, or support@truthehealth.com with the subject line "DMCA Notice." We may remove allegedly infringing material and may terminate repeat infringers in appropriate circumstances. A person who knowingly materially misrepresents infringement may be liable for damages under 17 U.S.C. Section 512(f).
Sweepstakes, contests, giveaways, discounts, and other promotions offered through the Truthe Sites may be governed by separate official rules, which constitute Additional Terms. If a promotion's rules conflict with these Terms, the rules control for that promotion. It is your responsibility to review applicable rules before participating.
We strive to describe products accurately, but we do not warrant that product descriptions, specifications, pricing, availability, images, or other Content are complete, accurate, reliable, current, or error-free. Products may be reformulated, and labels may change; always read the label, warnings, and directions provided with a product before use, and rely on the physical label over Site Content in the event of any conflict. We may correct errors, inaccuracies, or omissions, and may change or update information, at any time without prior notice, including after you have submitted an order, as further described in the Terms of Sale.
These Terms are effective until terminated. We may suspend or terminate your access to the Truthe Sites, or any feature of them, at any time and for any lawful reason, including violation of these Terms, without notice or liability. You may stop using the Truthe Sites at any time. All provisions of these Terms that by their nature should survive termination will survive, including the medical disclaimers, ownership and license provisions, user content licenses, disclaimers of warranties, limitations of liability, indemnification obligations, dispute resolution and arbitration provisions, governing law, and general provisions.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TRUTHE SITES, THE SERVICES, AND ALL CONTENT AND MATERIALS ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND. TRUTHE AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS (COLLECTIVELY, THE "TRUTHE PARTIES") DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND SYSTEM INTEGRATION, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. THE TRUTHE PARTIES DO NOT WARRANT THAT THE TRUTHE SITES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE TRUTHE SITES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS SECTION DOES NOT LIMIT ANY EXPRESS WRITTEN PRODUCT WARRANTY PROVIDED WITH A PHYSICAL PRODUCT, ANY WARRANTY REQUIRED BY APPLICABLE LAW WITH RESPECT TO A PHYSICAL PRODUCT, OR ANY RIGHT YOU HAVE THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW. PURCHASES OF PRODUCTS ARE SUBJECT TO THE WARRANTY PROVISIONS OF THE TERMS OF SALE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT WILL THE TRUTHE PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE TRUTHE SITES, THE CONTENT, OR THE SERVICES, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) THE TOTAL AGGREGATE LIABILITY OF THE TRUTHE PARTIES ARISING OUT OF OR RELATING TO THESE TERMS, THE TRUTHE SITES, THE CONTENT, OR THE SERVICES WILL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID TO TRUTHE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (II) ONE HUNDRED U.S. DOLLARS ($100). THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY A PHYSICAL PRODUCT TO THE EXTENT SUCH LIMITATION IS PROHIBITED, AND DO NOT LIMIT THE LIABILITY PROVISIONS OF THE TERMS OF SALE WITH RESPECT TO PRODUCT PURCHASES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Truthe Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your use or misuse of the Truthe Sites or the Services; (c) your breach of these Terms or any Additional Terms; (d) your violation of applicable law or the rights of any third party; (e) inaccurate, incomplete, or false information you provide; or (f) if you participate in an Affiliate Program, your marketing activities and communications. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense. You may not settle any such matter without our prior written consent. This section does not require you to indemnify any Truthe Party for that party's own gross negligence or willful misconduct, or to the extent prohibited by applicable law.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND TRUTHE TO RESOLVE MOST DISPUTES THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION AND WAIVES THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS, UNLESS YOU OPT OUT AS DESCRIBED BELOW.
Scope. This section applies to any dispute, claim, or controversy between you and Truthe arising out of or relating to these Terms, any Additional Terms, the Truthe Sites, the Content, the Services, or any product or program offered through the Truthe Sites, whether based in contract, tort, statute, or any other theory, and whether arising before, on, or after the date you accepted these Terms (each, a "Dispute"). This section is consistent with, and is intended to be read together with, the dispute resolution provisions of the Terms of Sale; for Disputes arising from a purchase, the Terms of Sale govern to the extent of any conflict.
Informal resolution first. Before initiating arbitration, the party asserting a Dispute must send the other party an individualized written notice describing the nature of the Dispute, the specific relief sought, and the claimant's name and contact information. Notice to Truthe must be sent to support@truthehealth.com with the subject line "Legal Dispute Notice." The parties agree to negotiate in good faith, which may include an individualized telephone or video conference if either party requests one. If the Dispute is not resolved within sixty (60) days after receipt of a complete notice, either party may commence arbitration. Compliance with this paragraph is a condition precedent to arbitration, and the arbitrator or a court may stay proceedings pending compliance.
Agreement to arbitrate. Except as provided below, all Disputes, including disputes about the scope, enforceability, or validity of this arbitration provision, will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, each as in effect when the arbitration is commenced. The Federal Arbitration Act, 9 U.S.C. Sections 1-16, governs the interpretation and enforcement of this section. The arbitration will be conducted by a single arbitrator in the county where you reside, by videoconference, or on written submissions, as permitted by the applicable AAA rules. Payment of filing, administration, and arbitrator fees will be governed by the AAA rules; Truthe will pay those fees to the extent required for this provision to be enforceable. The arbitrator will issue a reasoned written decision, may award the same individual relief that a court could award, and judgment on the award may be entered in any court of competent jurisdiction.
Exceptions. Either party may (a) bring an individual claim in small claims court in any qualifying jurisdiction, and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. In addition, nothing in this section prevents you from bringing a Dispute to the attention of any federal, state, or local government agency, and this section does not apply to any claim that may not be arbitrated as a matter of law. Disputes with independent healthcare providers, pharmacies, or the Telehealth Vendor are governed by your separate agreements with those parties, and nothing in this section requires arbitration of any claim against a healthcare provider relating to clinical care.
Coordinated filings. If twenty-five (25) or more demands for arbitration are filed against Truthe that raise similar claims and are brought by or with the assistance of the same or coordinated counsel ("Coordinated Cases"), the parties agree that the AAA Mass Arbitration Supplementary Rules will apply, and that the Coordinated Cases will proceed in staged proceedings: first, up to ten (10) cases selected in equal number by each side will be filed and resolved as bellwether arbitrations; the parties will then engage in a global mediation informed by those results; and remaining cases may thereafter be filed in successive stages of up to twenty-five (25) cases per side per stage. Applicable statutes of limitations will be tolled for unfiled Coordinated Cases from the date a compliant informal-resolution notice is received until the case may be filed under this paragraph. If any Coordinated Case remains unfiled twenty-four (24) months after its compliant informal-resolution notice was received, either party to that case may elect to have that case proceed immediately as an individual arbitration or in small claims court, notwithstanding the staging described above. A court of competent jurisdiction has authority to enforce this paragraph and, if necessary, to enjoin mass filings that do not comply with it. If this paragraph is found unenforceable, the Coordinated Cases will be administered by the AAA under its then-applicable rules.
CLASS ACTION AND JURY TRIAL WAIVER. ALL DISPUTES WILL BE ARBITRATED OR LITIGATED ONLY ON AN INDIVIDUAL BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TRUTHE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. IF A DISPUTE IS FOUND NOT SUBJECT TO ARBITRATION, THIS WAIVER STILL APPLIES TO LITIGATION OF THAT DISPUTE TO THE FULLEST EXTENT PERMITTED BY LAW. IF THE PROHIBITION ON CLASS ARBITRATION IN THIS PARAGRAPH IS FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM, THEN THAT CLAIM, AND ONLY THAT CLAIM, MUST BE SEVERED AND BROUGHT IN COURT, AND THE REMAINDER OF THIS SECTION REMAINS IN EFFECT.
Opt-out. You may reject this arbitration provision and class action waiver by sending written notice to support@truthehealth.com, subject line "Arbitration Opt-Out," or by mail to Truthe Health Inc., c/o Registered Agents Inc., 30 N Gould St, Ste R, Sheridan, WY 82801, within thirty (30) days after you first accept these Terms, stating your name, address, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration under these Terms also constitutes opting out under the Terms of Sale, and vice versa. Opting out will not affect any other provision of these Terms. If you previously accepted these Terms, changes to this section do not apply to Disputes of which we received notice before the change, and you may reject a material change to this section within thirty (30) days of its effective date by the same method, in which case the prior version of this section applies.
Survival. This section survives termination of these Terms and your relationship with Truthe.
These Terms and any Dispute are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 25. For any matter not subject to arbitration, you and Truthe consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming, and each party waives any objection to such venue on the ground of inconvenient forum. Nothing in this section deprives you of the protection of mandatory consumer protection laws of the state in which you reside to the extent those laws apply notwithstanding a choice-of-law provision.
You consent to receive agreements, notices, disclosures, and other communications from us electronically, and you agree that electronic communications satisfy any legal requirement that communications be in writing. You agree that clicking to accept, checking a box, or otherwise electronically indicating assent constitutes your electronic signature and binds you to the same extent as a handwritten signature. You may withdraw consent to electronic delivery, or request paper copies, by contacting support@truthehealth.com; withdrawal may limit your ability to use the Services.
Pursuant to California Civil Code Section 1789.3, California users are entitled to the following notice: the Truthe Sites are operated by Truthe Health Inc. Complaints regarding the Truthe Sites or requests for further information may be sent to support@truthehealth.com or to the mailing address in Section 32. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. California residents under eighteen (18) years of age who have posted content on the Truthe Sites may request removal of that content by contacting support@truthehealth.com with a description of the content and its location; we will make good faith efforts to remove it from public view, though complete removal from all systems cannot be guaranteed.
Truthe is committed to making the Truthe Sites accessible to all users, including individuals with disabilities, and works toward conformance with recognized accessibility standards such as the Web Content Accessibility Guidelines. If you experience difficulty accessing any part of the Truthe Sites, or require content in an alternative format, contact support@truthehealth.com and we will work with you in good faith to provide the information or service you seek through an alternative method.
The Truthe Sites are operated from the United States and are intended for users located in the United States. We make no representation that the Truthe Sites, Content, or products are appropriate or available for use in other locations, and access from jurisdictions where the Content or products are unlawful is prohibited. If you access the Truthe Sites from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.
Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Assignment. You may not assign these Terms without our prior written consent; we may assign these Terms freely, including to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. No waiver. Our failure or delay in exercising any right is not a waiver of that right. No agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Truthe, and independent healthcare providers, pharmacies, and the Telehealth Vendor are not agents of Truthe. Third-party beneficiaries. The Truthe Parties are intended third-party beneficiaries of Sections 22, 23, 24, and 25; otherwise these Terms create no third-party rights. Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control. Headings. Headings are for convenience only. Entire agreement. These Terms, together with the Privacy Policy, the Terms of Sale, and any applicable Additional Terms, are the entire agreement between you and Truthe regarding the Truthe Sites and supersede all prior agreements on that subject.
